1. Acceptance of Terms
By accessing or using the HelloSIM website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including customers, visitors, and anyone who accesses our platform.
2. Description of Services
HelloSIM provides digital eSIM data plans for international travel. Our services include:
- Sale and digital delivery of eSIM data plans
- eSIM profile provisioning and activation
- Data plan management and top-up services
- Customer support for eSIM-related issues
3. Account Registration
To purchase eSIM plans, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete registration information and to update it as needed.
4. eSIM Compatibility
Important: Before purchasing, you must verify that your device supports eSIM technology. HelloSIM is not responsible for purchases made for incompatible devices. Please check our compatible devices list before ordering.
5. Pricing, Taxes & Payments
- All prices are displayed in Euros (EUR) and are inclusive of all applicable taxes (including VAT/sales tax where it applies). The price shown at checkout is the total price you pay — there are no hidden fees or additional taxes charged on top.
- Where taxes are due on a sale, HelloSIM is responsible for collecting and remitting those taxes to the relevant authorities. You are not required to pay any further tax to us in connection with your purchase.
- Payment is processed securely through Stripe at the time of purchase. We accept major credit/debit cards and other payment methods shown at checkout.
- Prices are subject to change without prior notice, but plans already purchased remain at the price paid.
6. Digital Delivery & Your Consent to Immediate Delivery
eSIM profiles are digital goods delivered electronically immediately after successful payment. Your eSIM — including the QR code and/or activation details — is sent to the email address you provide and made available in your account dashboard.
By completing your purchase, you expressly request that we begin delivery of the eSIM immediately, and you acknowledge and agree that: (a) delivery is deemed complete as soon as the eSIM QR code and/or activation details are sent to your email and/or made available in your account, regardless of whether you open the email, install, activate or use the eSIM; and (b) by requesting immediate delivery of digital content, you lose and expressly waive any statutory right of withdrawal, cooling-off, or cancellation to the fullest extent permitted by applicable law.
7. No Refunds — All Sales Are Final
Because eSIMs are digital goods that are delivered instantly and cannot be returned, all sales are final and non-refundable once the eSIM has been delivered — that is, once the QR code and/or activation details have been sent to your email and/or made available in your account. This applies whether or not you have opened the email, installed, activated, or used the eSIM.
Non-refundable (no exceptions)
- The eSIM has been delivered to your email and/or account
- You changed your mind, no longer need the plan, or purchased by mistake
- Data has been used, or the validity period has started or expired
- The purchase was made for an incompatible, carrier-locked, or unsupported device (it is your responsibility to verify compatibility before buying)
- You did not install or activate the eSIM in time
Limited exception — verified defect
The only exception is an eSIM that is verifiably defective and that our technical team is unable to make work after reasonable troubleshooting, and on which no data has been consumed. In that limited case we will, at our discretion, provide a replacement eSIM or — only if no working replacement is possible — a refund. Nothing in these Terms removes any mandatory rights you may have under applicable consumer law for digital goods that are faulty or not as described.
Chargebacks: Initiating a chargeback or payment dispute for an eSIM that was validly delivered under these Terms is a breach of this agreement. We retain delivery logs and your consent record and will contest such disputes, and we may suspend any account associated with an abusive chargeback.
8. Data Plan Usage
- Data plans have a specified data allowance and validity period
- Once the data allowance is depleted or the validity period expires (whichever comes first), the plan will no longer provide data
- Unused data does not roll over to new plans
- Data speeds may vary depending on network coverage and congestion
- Plans are for personal use only; commercial use or reselling is prohibited
9. Fair Usage Policy
All data plans are subject to a fair usage policy. Activities that may violate this policy include, but are not limited to: excessive tethering, peer-to-peer file sharing, operating servers, or any activity that negatively impacts network performance for other users. We reserve the right to throttle or suspend service for violations.
10. Limitation of Liability
HelloSIM provides eSIM services "as is" without warranties of any kind. We are not liable for network outages, coverage gaps, speed variations, or any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the specific service in question.
11. Intellectual Property
All content, trademarks, logos, and intellectual property on the HelloSIM platform are owned by HelloSIM or its licensors. You may not use, reproduce, or distribute any content without our prior written consent.
12. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the updated terms. We will notify users of material changes via email.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Albania. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Albania.
